This paper reviews the origin of inertia according to Mach's principle and Weber's law of gravitation. The resulting theory is based on simultaneous nonlocal gravitational interactions between particles in the solar system and others in the remote universe beyond the Milky Way galaxy. It explains the precession of the perihelion of Mercury. A most important implication of the Mach-Weber theory of the force of inertia is the necessity for a large amount of uniformly distributed matter in the galactic universe. Nonlocal inertia forces are compatible with a static universe and also with an expanding universe but the latter would demand slow changes in the mass of particles and the gravitational constant. The resident, known as Dr. Doe, claimed that his termination violated federal laws protecting persons with disabilities. The court upheld the hospital's actions as lawful and affirmed the trial court's grant of summary judgment for the hospital.Dr. (...) P. M. S. Hacker's tetralogy on human nature (2007–2021) is a recent contribution to philosophical anthropology. In this work, the expression ‘form of representation’ appears at crucial points of discussion. This paper begins with an exposition and analysis of this notion, followed by a look at how it is utilised in the discussion of knowledge, the mind, and other emotive and moral concepts. It then turns to a comparison of ‘forms of representation’ with two important concepts, namely, analogy and metaphor. (...) Monetary intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the dark side of monetary Intelligence and behavioral economics—dishonesty. Dishonesty, a risky prospect, involves cost–benefit analysis of self-interest. We frame good or bad barrels in the environmental context as a proxy of high or low probability of getting caught for dishonesty, respectively. We theorize: The magnitude and intensity of (...) the relationship between love of money and dishonest prospect may reveal how individuals frame dishonesty in the context of two levels of subjective norm—perceived corporate ethical values at the micro-level and Corruption Perceptions Index at the macro-level, collected from multiple sources. Based on 6382 managers in 31 geopolitical entities across six continents, our cross-level three-way interaction effect illustrates: As expected, managers in good barrels, mixed barrels, and bad barrels display low, medium, and high magnitude of dishonesty, respectively. With high CEV, the intensity is the same across cultures. With low CEV, the intensity of dishonesty is the highest in high CPI entities —the Enron Effect, but the lowest in low CPI entities. CPI has a strong impact on the magnitude of dishonesty, whereas CEV has a strong impact on the intensity of dishonesty. We demonstrate dishonesty in light of monetary values and two frames of social norm, revealing critical implications to the field of behavioral economics and business ethics. (shrink)

Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration (...) as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level 2) to maximize expected utility and ultimate serenity. We challenge the myth: Pay satisfaction mitigates dishonesty across nations consistently. Based on 6500 managers in 32 countries, our cross-level three-dimensional visualization offers the following discoveries. Under high aspiration conditions, pay dissatisfaction excites the highest- (third-highest) avaricious justice-seeking dishonesty in high (medium) CPI nations, supporting the certainty effect. However, pay satisfaction provokes the second-highest avaricious opportunity-seizing dishonesty in low CPI entities, sustaining the possibility effect—maximizing expected utility. Under low aspiration conditions, high pay satisfaction consistently leads to low dishonesty, demonstrating risk aversion—achieving ultimate serenity. We expand prospect theory from a micro and individual-level theory to a cross-level theory of monetary wisdom across 32 nations. We enhance the S-shaped Curve to three 3-D corruption surfaces across three levels of the global economic pyramid, providing novel insights into behavioral economics, business ethics, the environment, and responsibility. Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. At the time of this writing, the late Myles Brand was the President of Indiana University and a member of the IU Department of Philosophy.

Deep brain stimulation — a novel surgical procedure — is emerging as a treatment of last resort for people diagnosed with neuropsychiatric disorders such as severe obsessive-compulsive disorder. The US Food and Drug Administration granted a so-called humanitarian device exemption to allow patients to access this intervention, thereby removing the requirement for a clinical trial of the appropriate size and statistical power. Bypassing the rigors of such trials puts patients at risk, limits opportunities for scientific discovery, and gives device manufacturers (...) unique marketing opportunities. We argue that Congress and federal regulators should revisit the humanitarian device exemption to ensure that it is not used to sidestep careful research that can offer valuable data with appropriate patient safeguards. In Community Matters: Challenges to Civic Engagement in the 21st Century, six distinguished scholars address three perennial challenges of civic life: the making of a citizen, how citizens are to agree , and how to define the rights and responsibilities of citizenship. These essays will encourage students, academics, and interested citizens outside the academy to go farther and dig deeper into these vital issues.

The editor of this text has brought together fifteen selections representing some of the major contributions philosophers have made to the study of the aims of education. This anthology is organized into three parts: classical, modern and analytic philosophies of education. Each selection is preceded by the editor’s one page introduction, which unfortunately is far too short to prepare the student to deal technically with the material. In the part devoted to classical writings on education, texts from Plato and Aristotle (...) are offered with no regard to the cultural setting, while the excerpts from Locke, Rousseau and Kant seem to be presented principally with a concern for moral education. The five modern selections are far more interesting, particularly those from Dewey and Russell. The material from Maritain and Whitehead is preponderantly practical, though Sidney Hook’s defense of Dewey will afford the student an appreciation of careful argument. By far the most engaging part of the book is the last, comprising significant selections from Scheffler, Ryle and Jane Roland Martin. A portion of R. S. Peters’ Authority, Responsibility and Education is reprinted, but surprisingly enough, Peters’ far better book, Ethics and Education, is neglected. Cahn presents a short essay of his own, "Is There an Analytic Philosophy of Education?" which he probably would have modified had he been acquainted with Peters’ recent work. The likely use of this anthology is the teacher education course commonly referred to coincidentally by the same title. It is to Cahn’s credit that he has attempted to expose the education student to genuine philosophy, yet this anthology presents a mere mass of material without an effort at providing direction, structure or synthesis. The serious philosophical work of systematically analyzing education, culture, self and meaning still remains as much a task as it did before, though now thanks to Cahn some of the working materials for such an endeavor have been made more available.—J. The advent of personal genomics companies offering direct translation of scientific data into personal health information, calls into question traditional policies to refuse disclosure of such scientific data to research participants. This seems especially true for population biobanks, as they collect not only genotype information but also associated phenotype information, and thus may be in a unique position to translate their scientific findings into personal health information for their participants. Disclosure of such information seems mandated by the expectations raised by (...) biobanks and their participants' rights to know health information, to know clinical research results, to life and health and particularly their right to benefit. Refusals to disclose such information can be grounded in the lack of analytical validity and/or clinical utility of most findings, the need to avoid the therapeutic misconception, the complexity and costs involved in translation and disclosure and the disproportionate burden resulting from the obligation to respect participants' right not to know before any disclosure can be made. Currently, any demands by participants in population biobanks for full disclosure of all pertinent personal health information potentially resulting from the biobank's scientific findings are unlikely to be granted by a Dutch court under Dutch and international law. As the law stands now, a population biobank is neither a doctor nor a personal genomics company. However, in view of the rapid scientific, medical, technological, commercial and social developments, population biobanks must prepare to take more care of their participants' legitimate interest in receiving as much validated personal health information as reasonably possible, in a timely fashion, by developing appropriate translation and disclosure mechanisms. This paper examines whether population biobank participants have the right, under Dutch civil law and international law, to full disclosure, i.e. to all information generated by the biobank that is pertinent to their present and future health. It pioneers the format of a hypothetical court case to elucidate the legal and policy arguments" for and against full disclosure. (shrink)

Unger has recently argued that if you are the only thinking and experiencing subject in your chair, then you are not a material object. This leads Unger to endorse a version of Substance Dualism according to which we are immaterial souls. This paper argues that this is an overreaction. We argue that the specifically Dualist elements of Unger’s view play no role in his response to the problem; only the view’s structure is required, and that is available to Unger’s opponents. (...) We outline one such non-Dualist view, suggest how to resolve the dispute, respond to some objections, and argue that ours is but one of many views that survive Unger’s challenge. All these views are incompatible with microphysicalism. So Unger’s discussion does contain an insight: if you are the only conscious subject in your chair, then microphsyicalism is false. Unger’s mistake was to infer Substance Dualism from this; for microphysicalism is not the only alternative to Dualism. (shrink)

These debates are dynamic, characterized by many voices contesting numerous storylines. The discoursal features, including language choices and communication strategies, of the GM debate are in some ways taken for granted and in others actively manipulated by participants. Although there are many voices, some have more influence than others. This study makes use of 50 hours of in-depth interviews (...) with GM scientists, nonexperts, and other stakeholders in the GM debate to examine this phenomenon. We uncover rhetorical devices used by scientists to characterize and ultimately undermine participation by non-experts in areas including rationality, knowledge, understanding and objectivity. Scientists engage with ‘the public’ from their own linguistic and social domain, without reflexive confirmation of their own status as part of the public and the citizenry. This raises a number of interesting ironies and contradictions, which are explored in the article. As such, it provides valuable insights into an increasingly important type of discourse. (shrink)

Debates about moral, legal and political attributions of responsibility do not, as can be seen in the past, occur in a vacuum. Against this background, the following chapter does not directly address the pending ethical questions about human germline editing, but calls attention to several stages of social and ethical discourse. The goal, not simply in the interest of history, is to uncover the genealogy of the climate of the debate. After all, the hidden genealogy of discourses often contributes to (...) the societal framing of a debate. Making these taken-for-granted assumptions explicit is of intrinsic value for further ethical debate. For possible argumentative short circuits, or abstractions, can be avoided through this making-explicit, and things forgotten or non-self-evident can be recalled in the advanced course of the debate. The focal point of this critical genealogy is the transition from the seemingly rather reserved statement of the so called Washington Summit of December 2015 to the about-face undertaken by the leading American academies in the report they published in February 2017. Finally, how trust in science can be maintained beyond such perceptible interest-led transformations is explained in the concluding chapter. (shrink)

In G. K. Chesterton's story The Doom of the Darnaways, Lord Darnaway put on the spines of dummy books in his library such empty designations as The Snakes of Ireland and The Religion of Frederick the Great : I too might appear to have chosen a non-subject for this paper. My coming to the contrary conclusion was the unwitting work of the man whom Balliol College employed to give us tutorials in political philosophy. I soon noticed that his interpretation of (...) Hobbes seemed to be based on a few chapters of Leviathan ; desiring to get material for probing questions, and allured by Hobbes's style, I quickly devoured the whole of Leviathan. This reading left me with an abiding respect for the moral and political philosophy of Hobbes; his religious views, at this time, I found curious rather than impressive, but already I had no doubt that they were not mere hollow professions thinly cloaking an immoralist atheism, but were considered opinions sincerely held. Our main result on computability is: For any n ≥ 2 and any computable (recursive) k-coloring of the n-element sets of natural numbers, there is an infinite homogeneous set X with X'' ≤ T 0 (n) . Let IΣ n and BΣ (...) n denote the Σ n induction and bounding schemes, respectively. Adapting the case n = 2 of the above result (where X is low 2 ) to models of arithmetic enables us to show that RCA 0 + IΣ 2 + RT 2 2 is conservative over RCA 0 + IΣ 2 for Π 1 1 statements and that $RCA_0 + I\Sigma_3 + RT^2_{ , is Π 1 1 -conservative over RCA 0 + IΣ 3 . It follows that RCA 0 + RT 2 2 does not imply BΣ 3 . In contrast, J. Hirst showed that $RCA_0 + RT^2_{ does imply BΣ 3 , and we include a proof of a slightly strengthened version of this result. Derek Longhurst’s rhetorical strategies don’t leave me much room to maneuver. By constructing my essay in such a way that we are opponents, he offers only two choices: I can recant or enter into battle. Actually, I would rather do neither; I agree with most of what he says and would like a chance to explore those points where we differ. But in order to do that, it is first necessary to see where our differences really lie; and Longhurst’s response (...) does not make it easy.Granted, some of his criticisms are sound. He is right that I use the word “we” too loosely and that I sketched out my argument on an extremely abstract level, which resulted in, among other things, a blurring of the differences between American and British literature. But more often than not, Longhurst attacks me for taking positions that I do not in fact hold. For instance, he suggests that I believe the categories “popular” and “serious” to be fixed, and that my scheme would therefore shatter when confronted with a text like The Citadel, which was regarded as “both ‘serious’ and ‘popular.’ ” Yet my essay was intended precisely to offer a way to talk about such cases—of which The Glass Key is one—and while my solution may have its flaws, the rigidity of categories that Longhurst attacks it for is surely not one of them. This is an editorial report on the outcomes of an international conference sponsored by a grant from the National Science Foundation to the School of Education at Boston University and the Center for Philosophy and History of Science at Boston University for a conference titled: How Can the History and Philosophy of Science Contribute to Contemporary US Science Teaching? The presentations of the conference speakers and the reports of the working groups are reviewed. Multiple themes emerged for K-16 education (...) from the perspective of the history and philosophy of science. Key ones were that: students need to understand that central to science is argumentation, criticism, and analysis; students should be educated to appreciate science as part of our culture; students should be educated to be science literate; what is meant by the nature of science as discussed in much of the science education literature must be broadened to accommodate a science literacy that includes preparation for socioscientific issues; teaching for science literacy requires the development of new assessment tools; and, it is difficult to change what science teachers do in their classrooms. The principal conclusions drawn by the editors are that: to prepare students to be citizens in a participatory democracy, science education must be embedded in a liberal arts education; science teachers alone cannot be expected to prepare students to be scientifically literate; and, to educate students for scientific literacy will require a new curriculum that is coordinated across the humanities, history /social studies, and science classrooms. Unlike marine mammals such as whales and dolphins who can never fully automate breathing—they sleep one brain hemisphere at a time so as to keep conscious watch, like yogis, over their respiration—we humans are mostly somnambulists with regard (...) to breath. Unlike our briny cousins, we won't drown if we neglect our breath. Our relatively accommodating habitat at the fold of lithosphere and atmosphere enables a Lethe of oblivion, though many elements of our world are hostile to breath: water, fire, earth, extremes of height, heat, or cold. Nothing could be more fundamental for aerobic terrestrial creatures than breathing. So its routine cloaking in impercipience must somehow be functional and require a great deal of nervous expenditure. (It always takes a lot of work to make an infrastructure invisible.)Breathing is a good test case for the notion, common to many variants of critical theory, that nature for humans is always second nature: what would it mean to find culture, history, and politics in something that is so relentlessly universal and given? The intensity of the urge for drink, food, sex, or sleep pales compared to that of taking a breath withheld or expelling a breath too long held. Here, it seems, desire and need converge. Breathing morphs into awareness, art and artifice when threat, absence or curiosity rouse it from its slumber—when we swim, have a coughing fit, sing, or challenge someone to a breath-holding contest. Under the earth in a mine, high in the air on a mountain or airplane, ill with a respiratory disease, or in other extreme situations, we need techniques and technologies to breathe. Like everything supposedly natural, we can't leave breathing in peace. We mold breath in techniques of speech, song, and prayer and in technologies of diving, medicine, and air travel. A full accounting of such would form a full encyclopedia of human ingenuity.1 [End Page 85]With typical flamboyance, Peter Sloterdijk declared that the atmosphere first ceased to be taken for granted, i.e., became technical, a matter of art, on 22 April 1915, with the German deployment of poison gas in World War I. On a world-historical scale, he takes this weaponization of the environment as an "air-quake" that launched modern air-conditioning in its most literal sense of climatization (as French and German has it) and not just interior cooling (Sloterdijk 89-110 passim). The EDPS Ethics Advisory Group (EAG) has carried out its work against the backdrop of two significant social-political moments: a growing interest in ethical issues, both in the public and in the private spheres and the imminent entry into force of the General Data Protection Regulation (GDPR) in May 2018. For some, this may nourish a perception that the work of the EAG represents a challenge to data protection professionals, particularly to lawyers in the field, as well as to companies (...) struggling to adapt their processes and routines to the requirements of the GDPR. What is the purpose of a report on digital ethics, if the GDPR already provides all regulatory requirements to protect European citizens with regard to the processing of their personal data? Does the existence of this EAG mean that a new normative ethics of data protection will be expected to fill regulatory gaps in data protection law with more flexible, and thus less easily enforceable ethical rules? Does the work of the EAG signal a weakening of the foundation of legal doctrine, such as the rule of law, the theory of justice, or the fundamental values supporting human rights, and a strengthening of a more cultural approach to data protection? Not at all. The reflections of the EAG contained in this report are not intended as the continuation of policy by other means. It neither supersedes nor supplements the law or the work of legal practitioners. Its aims and means are different. On the one hand, the report seeks to map and analyse current and future paradigm shifts which are characterised by a general shift from analogue experience of human life to a digital one. On the other hand, and in light of this shift, it seeks to re-evaluate our understanding of the fundamental values most crucial to the well-being of people, those taken for granted in a data-driven society and those most at risk. The objective of this report is thus not to generate definitive answers, nor to articulate new norms for present and future digital societies but to identify and describe the most crucial questions for the urgent conversation to come. This requires a conversation between legislators and data protection experts, but also society at large - because the issues identified in this report concern us all, not only as citizens but also as individuals. An adolescent’s last moment of life is an emotionally and medically complex time. Children may grapple with understanding the things happening to them and with grief of a future lost; caregivers struggle to simultaneously balance deep sorrow, hope, and love; and healthcare providers fight to maintain sound medical and ethical decision making. Increased discussion regarding adolescent end-of-life care is needed so that clinicians may better understand how to engage in ethically based medical management during these events. This holds particularly true (...) in situations where potentially conflicting ideas exist between clinicians and family members. We describe the case of an acutely and terminally ill adolescent who remained cognitively intact but with rapidly advancing multiple organ failure and whose parents requested that he remain uninformed of his critical illness and prognosis.
